DISTANCE SALES AGREEMENT
(INTERNATIONAL CONTRACT)

1. PARTIES
This Distance Sales Agreement (“Agreement”) is concluded electronically between the Seller and the Buyer under the terms set forth below.

1.2. Buyer Information
The "Buyer" is the individual or entity whose details are provided in the checkout form on the Website. The address and contact details specified in the order are accepted as the basis for this Agreement.
2. SUBJECT
The subject of this Agreement is to determine the rights and obligations of the parties regarding the sale and delivery of the product(s) ordered by the Buyer electronically via the Website, in accordance with the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts.
3. DEFINITIONS
- Site/Website: www.valeriavaux.com
- Product: The bridal gown or accessory ordered by the Buyer.
- Made-to-Order / Bespoke: Items that are not held in stock but are produced specifically for the Buyer based on their measurements, color selection, or specifications after the order is placed.
- Production Start: The moment when measurements are confirmed, materials are allocated, or cutting begins.
4. FORMATION OF CONTRACT
4.1. By confirming the order and completing the payment on the Website, the Buyer declares that they have read the preliminary information regarding the basic characteristics, sales price, and delivery method of the product and gives the necessary confirmation electronically.
4.2. This Agreement enters into force upon the Buyer's payment approval.
5. PRODUCT INFORMATION & PRICE
5.1. The type, quantity, model, color, and sales price (including taxes where applicable) of the Product are as stated in the order summary and the invoice sent to the Buyer.
5.2. Prices are subject to updates. The price valid at the moment of the transaction is binding.
6. NATURE OF GOODS (BESPOKE / NO STOCK)
6.1. Handcrafted Nature: The Buyer acknowledges that Valeria Vaux products are handmade. Slight variations in lace placement, fabric texture, or tone are inherent to the craft and do not constitute a "defect."
6.2. Bespoke Classification: Since the goods are produced specifically for the Buyer's order, they fall under the category of "Goods prepared in line with the consumer's wishes or personal needs" (Regulation on Distance Contracts, Art. 15/1-b).
7. BUYER RESPONSIBILITIES (MEASUREMENTS)
7.1. The Buyer is solely responsible for providing accurate measurements in accordance with the Seller's Measurement Guide.
7.2. The Seller is not liable for fit issues arising from incorrect measurements provided by the Buyer, weight fluctuations, or measurement errors made by third parties.
8. CANCELLATION & RETURN POLICY (STRICT)
8.1. 24-Hour Grace Period: The Buyer may cancel the order for a full refund within 24 hours of placement, provided that production has not started.
8.2. Right of Withdrawal (Excluded): Pursuant to Article 15/1-b of the Regulation on Distance Contracts, the Right of Withdrawal (14-day return without reason) DOES NOT APPLY to custom-made/bespoke products. All sales are final once the 24-hour window has passed.
8.3. Returns are only accepted in the case of a verified Manufacturing Defect.
9. DELIVERY & CUSTOMS (DDU TERM)
9.1. Shipping Term: Unless otherwise stated, international shipments are sent on a DDU (Delivery Duty Unpaid) basis.
9.2. Customs & Taxes: The Buyer is the importer of record and is responsible for all import duties, VAT, customs fees, and clearance charges levied by the destination country. Failure to pay these fees does not constitute grounds for a refund.
9.3. Risk Transfer: The risk of loss or damage to the goods passes to the Buyer upon delivery to the carrier or, at the latest, upon delivery to the Buyer.
10. DEFECTS & CLAIMS
10.1. Notification Period: The Buyer must inspect the Product upon delivery.
- Visible Transport Damage: Must be reported within 48 hours.
- Manufacturing Defects: Must be reported within 7 days.
10.2. Remedies: If a substantial manufacturing defect is verified by the Seller, the Seller may offer (a) Repair, (b) Remake, or (c) Partial Refund. Full refunds are reserved for severe non-conformity (e.g., wrong model sent).
10.3. Fit issues caused by the Buyer's measurements are NOT defects.
11. ALTERATION CREDIT
11.1. As a courtesy, the Seller may provide an alteration credit of up to $100 USD for minor local adjustments (hemming, strap adjustment). This requires a valid receipt from a tailor submitted within 14 days of delivery.
12. FORCE MAJEURE
The Seller is not liable for delays caused by circumstances beyond its reasonable control, including natural disasters, war, customs delays, or courier operational failures.
13. INTELLECTUAL PROPERTY
All designs, sketches, and visual content on the Website remain the intellectual property of Fabrika Gelinlik / Valeria Vaux. Unauthorized commercial use is prohibited.
14. APPLICABLE LAW & JURISDICTION
This Agreement is governed by the laws of the Republic of Türkiye. Any disputes arising from this Agreement shall be settled by the Consumer Arbitration Committees and Consumer Courts located in Bursa, Türkiye, within the monetary limits determined by law.
15. ACCEPTANCE
By placing an order, the Buyer acknowledges that they have read and agreed to all terms of this Agreement.
